A police report has been lodged against PKR de facto leader Anwar Ibrahim for allegedly sodomosing one of his aides… the second time that such an accusation had been made in over 10 years. [Malaysiakini]

Anwar responded that the report is a complete fabrication, which could be a retaliation for evidence he has recently obtained implicating IGP Musa Hassan and AG Gani Patail in misconduct including fabrication of evidence in the cases launched against him in 1998-1999.

When Anwar was first accused of sodomy in 1997… the people were separated in opinions; but this time, people would find it hard to believe that he’s not been framed.

Update – PM Badawi claimed that BN government is not behind this and would leave the police to conduct investigations on the allegations and to take the necessary action. [Thestar]

The first volume (191 pages) of the Royal Commission report on the VK Lingam video clip, which is the key portion of the report, is available online in PDF version via Malaysiakini.

Not sure if any common citizens would want to read through the 191 pages though; a few of the key highlights have been published in major newspapers anyway…

1. The video clip was authentic;

2. Lingam was having a phone conversation with former chief justice Tun Ahmad Fairuz Sheikh Abdul Halim;

3. Lingam was actively involved in the appointment of Ahmad Fairuz as President of the Court of Appeal, with the possible aim of his further appointment as Chief Justice;

4. Lingam had asked his close friends tycoon Tan Sri Vincent Tan and Datuk Seri Tengku Adnan Tengku Mansor to involve themselves actively in the appointment of judges, in particular the appointment of Ahmad Fairuz as the Chief Judge of Malaya and subsequently, President of the Court of Appeal;

5. The phone conversation indicated Lingam’s ‘uncanny knowledge’ of what could be considered as matters protected under the Official Secrets Act; and that,

6. Tengku Adnan appeared to be Lingam’s ‘source’ in the Prime Minister’s Department. [Thestar]

Meanwhile, Attorney-General Tan Sri Abdul Gani Patail has ordered a thorough follow-up on all the findings made by the Royal Commission of Inquiry as well as the 14-minute recording… which they probably should have done at the first place.

Abdullah Badawi announced yesterday (April 21) that the Anti-Corruption Agency (ACA) will be made a full-fledged commission by year-end. [Bernama]

The reformation plans are mostly focusing on improving the effectiveness and transparency of ACA, but there are a few big questions that remain unanswered. The biggest question is probably on how authoritative the ACA could be after the overhaul.

It’s reported that the final say on prosecution still lies on the Attorney General. Now, what would happen if the AG has ordered to stop an investigation prematurely?

The current AG Abdul Gani Patail has done it before, and who are going to stop AG from doing it again? And what freedom is ACA actually having if this situation is allowed to happen in future?

The reformation has to go hand in hand with other authorities, and there are lots of complications that need to be cleared to ensure a really independent ACA that could operate without any interference. Getting the right people to lead the ACA is another debatable issue too.

It’s a long way to go obviously, but it’s better than doing nothing. We’ll see how things are improve as time goes by.

Besides, reforming ACA is one thing… I think we need to overhaul our law and constitution regarding corruption as well. I believe there are many loopholes in our current system that could be exploited without breaking the law. ACA would be helpless in these situations regardless of how independent they are.

The Sessions Court here today acquitted and discharged 31 people charged with attempting to murder a police officer during an illegal assembly organised by the Hindu Rights Action Force (Hindraf) in front of the Sri Subramaniar temple in Batu Caves, near here, on Nov 25.

Judge Nursinah Adzmi made the decision after allowing the application by Attorney-General Tan Sri Abdul Gani Patail to withdraw the charges against them. [Bernama]

This have to be one of the biggest Malaysia jokes in 2007… it was a murder attempt charge, not chicken stealing. The AG should not have press the charges at the first place if he didn’t have enough evidence to prove the case… and if he does have solid evidence to prove it, they shouldn’t withdraw it at all.

I am not a law expert, but I know simple enough that our law should not be treated as a game… it’s controversial to press the charge, but it’s even worse to drop the case rather easily. The whole thing is just stupid.

Well, at least it’s good news for these 31 people… I hope that they are really innocent and not being let off for political reasons.

Hindu Rights Action Force (Hindraf) supporters were charged with attempted murder and causing damage to public property during the mass rally in Kuala Lumpur on Nov 25. [Malaysiakini]

No sympathy from me. I know some people will argue that the police were using tear gases, water cannons and some violent acts as well, but two wrongs don’t make one right… it doesn’t mean that it’s ok to throw bricks and iron pipes at the police when the cops were using force.

Yes, the charges might be biased and discriminative. It’s uncommon for Attorney General Abdul Gani Patail to personally handle the case when he is ignoring some other more pressing cases (Altantuya’s murder for example)… and besides that, I can’t stop wondering what has happened to the officer that fired 4 shots to the crowd at Batu Buruk fracas.

Still, it doesn’t mean that it is wrong to charge the Hindraf supporters. If there is anything to concern about… it’s to make sure that the prosecutors are not framing the accused but have solid proof to press the charges, and that the trial is handle fair and square with proper transparency.

Attorney General Abdul Gani Patail has ordered the Anti-Corruption Agency (ACA) to close 3 high-profile cases (former ACA chief Zulkifli Mat Noor, Inspector-General of Police Musa Hassan and Deputy Internal Security Minister Johari Baharum).

I have no clue if these people are corrupted or not, but I just felt that ACA could do better with their investigation methods.

According to reports ACA has done some investigations in those 3 cases by questioning the alleged parties and checking their bank statements and assets etc… nothing wrong with that; but do you think people will ever admitted to give or accept bribe? Do you think people will use direct banking to transfer money in bribery? Do you think people who accept bribe will put the assets they bought (with those money) under their own name?

Any person who watches enough Hong Kong series can tell that people are smarter than that… not just in TV, but in real life as well.

I can’t really suggest how ACA can improve their investigation, because I don’t have the expertise and resources to do so. However ACA should be filled with people and network that are capable to trace oversea accounts and accounts of people that are related to the alleged parties… not just investigations that can be done by amateurs like you and me.

I guess the biggest question though… is how independent ACA was acting when conducting investigations against those VIPs. ACA could be capable of conducting better investigations, but do they want to do so against the big guns? I don’t know.

Update July 31 – Former Sabah ACA director Mohamad Ramli Abdul Manan, who lodged the report against former ACA chief Zulkifli Mat Noor, claims that Zulkifli was cleared of corruption allegations only because the attorney-general failed to investigate the claims thoroughly. [Malaysiakini]

Mohamad lodged a report early this year alleging misconduct by Zulkifli by way of corrupt practices and sexual misconduct as well as irregularities and abuse of power.

Update August 2 – An anti-corruption watchdog (Transparency International Malaysia) has demanded full public disclosure of the basis for the government’s dismissal of corruption allegations against former Anti-Corruption Agency director-general Zulkipli Mat Noor and police chief Musa Hassan. [Malaysiakini]
