			<content:encoded><![CDATA[<p>Raja Petra Kamarudin has made a statutory declaration on June 18 alleging that Datin Seri Rosmah Mansor, Deputy Prime Minister Najib&#8217;s wife, was at the murder scene of Mongolian national Altantuya Shaariibuu. <p>The news is not picked up by the main media yet, but the blogosphere has been heated up with all sorts of discussions.</p>
<p>Whether the allegation is truth or not, I don&#8217;t know&#8230;  in fact only very few people would know at the moment.  RPK has shown his courage over the years, but frankly, sometimes he is abusing his influence to bully the politicians.</p>
<p><span id="more-331"></span>This is not the first time he is alleging that Najib was involved in Altantuya&#8217;s murder, but he has failed to produce any solid proofs besides empty talks so far.  I hope the cops and authorities will take his statutory seriously&#8230;  because if Najib is really guilty, I want him to face justice; if Najib is innocent, I would like to see RPK facing the song.</p>
<p>I always believe that <strong>everyone is innocent until proven not</strong>; that&#8217;s one of the basic cores of our constitution.  It sucks to let go of a criminal, but the last thing I want to see is innocent people being punished.</p>
<p>Don&#8217;t bother reminding me how corrupted our government and the judicial system are, because it&#8217;s not the point I am trying to make here.  </p>
<p>Lots of people don&#8217;t like Najib, I personally am not fond of this fella at all.  However, that doesn&#8217;t mean that we should implicate that he (or his wife) is a murderer without having solid evidences or investigations.</p>
<p>It&#8217;s saddening thing to see some Malaysians having their logical minds being taken control by their senseless emotions, just go and read some comments on <a href="http://www.malaysia-today.net/2008/content/view/9050/84/">Malaysia-Today</a>, <a href="http://blog.limkitsiang.com/2008/06/21/rpks-bombshell-allegation-on-altantuya-murder-abdullah-najib-rosmah-cannot-remain-silent/">LKS&#8217; blog</a>, <a href="http://anwaribrahimblog.com/2008/06/21/perakuan-sumpah-raja-petra/">Anwar&#8217;s blog</a> ans <a href="http://sloone.wordpress.com/2008/06/21/raja-petras-statutory-declaration-worst-than-c4/">Susan&#8217;s blog</a>&#8230;  and you would see so many Malaysians sentencing Najib to guilt as if they were right on the crime scene and saw everything.</p>
<p>Imagine how would your love ones feel if you are being wrongly investigated, charged or prosecuted for a murder that you never committed?  Imagine how would you feel if your family member is being accused of doing things that they never did?  It could be one of the worst things that you would want to happen in your life.</p>
<p>What we want to see is to have justice served; and as said earlier, I hope to see the authorities taking RPK&#8217;s declaration seriously&#8230;  after all, it&#8217;s not fun to risk being sentenced to jail just to mock a person you really hate.  But until then, Najib is not a murderer, and it&#8217;s unfair to accuse him of being so without knowing the facts.</p>
<p>Use your heart, use your mind, and not let your emotion taking control of your soul my fellow Malaysians.  Show some mercy.</p>

			<content:encoded><![CDATA[<p>Petrol stations located in border states will be barred from selling petrol and diesel to foreign-registered cars <strike>starting Friday (May 30)</strike>.  [<a href="http://thestar.com.my/news/story.asp?file=/2008/5/27/nation/21370395">Thestar</a>]</p>
<p><strike>Update &#8211; the plan has been postphoned.  The northern border will start the ban on June 2 while southern border on June 9.</strike></p>
<p>Update June 5 &#8211; the ban has been lifted following the <a href="http://yeinjee.com/malaysia/2008/fuel-hike-78-cents-to-rm270-per-litre/">new petrol scheme</a>.</p>
<p>Domestic Trade and Consumer Affairs Minister Datuk Shahrir Samad said the move is aimed at plugging loopholes in the current subsidy system; but the move is temporary until the ministry could come up with better management of the subsidy system.</p>
<p><span id="more-274"></span>The ban will involve between 200 and 300 petrol stations, and extends up to 50 kilometres from the borders in Kedah, Kelantan, Perlis, Perak and Johor.  Currently, petrol stations are not allowed to sell more then 20 litres of petrol to foreign vehicles.</p>
<p>A Singaporean friend was telling me that Malaysia is coming out with this rule to revenge <a href="http://yeinjee.com/malaysia/2008/pulau-batu-puteh-goes-to-singapore/">the lost of Batu Puteh</a>.  It was just a joke, but it makes me wonder if there are any Singaporeans who actually thought about that and took it seriously.</p>
<p>The decision is set to raise some controversies.  While it might help curbing the issue directly, it would lead to other matters like tourism and foreign relations.  It&#8217;s easy to count the amount of subsidy saved from the new rule, but the intangible losses might be larger than what we would gain.</p>
<p>Actually, the logical way to coup with the issue is to reduce our petrol subsidy and increase our fuel price.  The subsidies money could be better spent to improve our infrastructures and public transports, which in long term is the only way to reduce the mass consumption of petrol in our country.</p>
<p>The problem is whether the extra money saved from reducing the subsidy would be well spent and not wasted&#8230; we have seen too much mismanagement of public funds over the years that we have generally lost faith with our government obviously.</p>
<p>The snowball effect on other consumer goods will also be a concern, but it could be controlled with proper monitoring and management.</p>
<p>Reducing the subsidy is the only way to go&#8230;  Malaysians have been pampered all these years; it&#8217;s time to have some reality check.  Besides, the rich people are the ones that benefited most from the fuel subsidies anyway&#8230; it is not helping as much for the poor.</p>

<p>It&#8217;s funny reading how many times Samy Vellu had to stress that it&#8217;s not a political stunt; I doubt many would agree with him in this sense.  He should have make the call much earlier, but it&#8217;s better late than never&#8230;  political stunt or not, I don&#8217;t really mind as long as it makes a change at the end.</p>
<p>This raise the same old issue again&#8230;  what&#8217;s the point of having ISA at the first place?  It&#8217;s probably the most barbaric act we have in Malaysia.  I can understand the need for certain laws to protect the nation against terrorism or racial crash, but locking up people without trial for months and years is just not right.</p>
<p>I would have support an act to detain a suspicious terrorist for prolonged period, say for 14 or 28 days&#8230;  but if there is no solid proofs to file any charges, the suspect have to be let go.  It&#8217;s one of the basic fundamentals of our constitution&#8230;  that we would rather let a criminal off the hook than to put an innocent man into wrong justice.</p>
<p>I am not saying that the Hindraf 5 are innocent; the <a href="http://yeinjee.com/malaysia/2007/hindraf-memorandum-to-uk-prime-minister/">Hindraf memorandum</a> still rings in my mind occasionally&#8230;  truth or not it&#8217;s seditious nonetheless.  However, it&#8217;s just not right to detain anyone without giving them a fair trial.</p>
<p>It&#8217;s not just about releasing the Hindraf 5&#8230;  ISA should be abolished.</p>

<p>Some 1,000 Bangladeshi workers have been living along the cemented banks of Sungai Gombak, behind the Bangladesh High Commission, for the past two weeks after leaving their employers with claims of abuse and delayed salary payments.</p>
<p>The Bangladeshis have mixed complaints, with the majority alleging that they had not been paid their salaries for up to nine months.  Others said their work did not match the job stated in their employment contract, while others alleged physical abuse, including beatings.</p>
<p>I hope the government is taking this issue seriously&#8230;  it&#8217;s unacceptable that slavery is still happening in the 21st century.  It is an embarrassment to our country, and it&#8217;s a violation of basic human rights.</p>

<p>I don&#8217;t feel good about this at all.  I am against the use of ISA, but I am also against using children to fight for political or social causes.</p>
<p>I can understand the girl&#8217;s pledge to have her father home&#8230;  but to fight for the rights of Indians?  Am I supposed to believe that a 5-year-old girl could have such a mature thinking without being influenced or exploited by the adults?</p>
<p>Believe in what you want&#8230;  I see this as a shameful exploitation.</p>

<p>2. APPEAL FOR U.K TO MOVE EMERGENCY U.N RESOLUTION CONDEMNING “ETHNIC CLEANSING” IN MALAYSIA.</p>
<p>3. APPEAL TO REFER MALAYSIA TO THE WORLD COURT AND INTERNATIONAL CRIMINAL COURT FOR CRIMES AGAINST IT’S OWN ETHNIC MINORITY INDIANS.</p>
<p>We refer to the above critical matters in Malaysia but which generally gets the least attention locally even by the Opposition parties, NGO’s, the Malaysian Human Rights Commission and the media for this community is generally regarded as politically insignificant, do not draw local or international funding and are deemed not pressworthy. To the contrary the Malaysian government has successfully projected itself to the world as a modern Islamic thinking country which is not true.</p>
<p>The ethnic minority Indians in Malaysia were brought in to Malaysia by the British some 200 over years ago. Since independence in 1957 the Malaysian Indians have been permanently colonialised by the Islamic fundamentalist and Malay chauvinists UMNO led Malaysian government.</p>
<p>Among the recent atrocities committed by this government are as follows:-</p>
<p>1.100 over Indians were slashed and killed by the UMNO controlled Malaysian government in the Kampung Medan mini genocide. Despite numerous appeals, the Malaysian Human Rights Commission has refused to hold a Public Inquiry. The UMNO controlled Malaysian courts struck off a victim’s public interest civil suit for a Public Inquiry to be held without even the said UMNO controlled government having to file in their defence. The UMNO controlled Attorney General and the Inspector General of Police refused to investigate and / or initiate an inquest into the death of at least six Indians in this tragedy despite.</p>
<p>2. Every week one person at average is killed in a shot to kill policy and in every 2 weeks one person is killed in police custody. About 60% of these victims are Indians though they form only 8% of the Malaysian population.</p>
<p>3. In every three weeks one Hindu temple is demolished in Malaysia.</p>
<p>The latest being the demolishment of the Mariaman temple in Padang Jawa, Shah Alam, Selangor early this morning (15.11.2007) and the next being the (Mutaiya) Hindu temple in Sungai Petani scheduled for the 29.11.2007.</p>
<p>A violent armed pre down attack at 4.00a.m this morning was launched by the UMNO controlled Malaysian government backed by about 600 police, riot police, Islamic extremist and armed terrorists which completely destroyed this temple.</p>
<p>In an attack two weeks ago, uniformed police, riot police and city Council officers hurled rocks and attacked unarmed Hindu devotees with knives, sticks and iron rods.</p>
<p>At least 20 Hindu devotees were seriously injured and 19 arrested including 4 of their United Kingdom trained lawyers in direct violation of Article 5 (Right to life) Article 8 (Equality) Article 11 (Freedom of Religion) Section 295 (defiling a place of worship), Section 296 (disturbing a religious assembly), 298A(causing racial disharmony) and Section 441(criminal trespass) of the Malaysian Penal Code.</p>
<p>These authorities are plagued by an above the law mindset and in fact liberally take the law into their own hands. These atrocities however does not happen to almost all Islamic places of worship. Please visit www.policewatchmalaysia.com for further and better particulars.</p>
<p>4. State sponsored direct discrimination against the Indians in Public University intakes, Indian (Tamil) Schools, skills training institutes, civil service and private sector job opportunities, business and license opportunities and in almost all other aspects of daily life.</p>
<p>Despite our hundreds of letters, appeals and pleas to the Malaysian King and Sultans, the Prime Minister, Attorney General, Inspector General of Police, Ministers, Chief Ministers and the latest being our letters to the Prime Minister dated 29.10.2007 and 30.10.2007 and to the Attorney General dated 1.11.2007 the Malaysian authorities are only proceeding with greater ferocity and with impunity with very little regard for the Federal Constitution and laws of Malaysia. So please help us.</p>
<p>CONCLUSION</p>
<p>We fear that this peace loving Indian community of Tamil origin having been pushed to the corner and the persecution getting worse by the day may be forced to into terrorism in a matter of time as what has happened to the Sri Lankan Tamils.</p>
<p>APPEAL</p>
<p>On our part we are committed to a peaceful and lawful struggle and pray and appeal that the Government of the United Kingdom:-</p>
<p>1. Moves an emergency United Nations resolution condemning these state sponsored atrocities and persecutions of Malaysian Indians in Malaysia.</p>
<p>2. Refers Malaysia to the World Court and the International Criminal Court for Crimes against it’s own ethnic minority Indians</p>

<p>What has Hindraf achieved in the end?</p>
<p>Don&#8217;t get me wrong.  As mentioned at my <a href="http://yeinjee.com/malaysia/2007/hindraf-some-thoughts/">previous post</a>&#8230;  although I am not a public demo fan, I don&#8217;t feel that I have the right to deny others the freedom of expression.  However, I am really confused on what Hindraf is fighting for.</p>
<p>In general view&#8230;  Hindraf has planned the gathering to submit their petition to Queen Elizabeth II seeking support for the Indian community in a  US$4 trillion class action suit against the British government for bringing Indians as labourers to the then Malaya and thereafter exploiting them.</p>
<p>The suit is a joke; the Hindraf organizers should know that.  Initially I gave them beneficial of doubts thinking that they are using the suit to gain wide attention to the social problem instead of taking the monetary claim seriously&#8230;  I hope I was right.</p>
<p>I have doubts on what Hindraf is trying to achieve with the protest though.  After taking all the effort to bring people to the streets to endure the tear gas and water cannon&#8230;  Hindraf failed to make a constructive point of what they are fighting for.</p>
<p>Ya, I know&#8230; fighting for equal rights for Indian minorities.  However, what exactly do Hindraf want?  They have to make their demand clear and precise.</p>
<p>More Indian schools?<br />
More public servicing jobs for Indians?<br />
Minimum wage for blue collars?<br />
Stop demolition of Hindu temples?<br />
Permits for Hindu temples?<br />
Samy Vellu to step down from leadership?</p>
<p>So, what is Hindraf actually fighting for?  Precisely?</p>

			<content:encoded><![CDATA[<p>The police has arrested three key leaders behind the Hindu Rights Action Force (Hindraf) &#8211; lawyers P Uthayakumar, P Waythamoorthy and V Ganapathy Rao, just as the movement is preparing for a mass rally this Sunday (Nov 25). <p>Klang Valley folks should have noticed the unusual jam in and around KL for the past 2 days.  Police has set up roadblocks, albeit prematurely, to cope with the potential confrontation before the rally.  Seems like they has just up their ante by arresting the leaders of Hindraf.</p>
<p><strong>About Hindraf and the rally</strong></p>
<p>Not many Malaysians beside the Hindu community are paying attention to Hindraf&#8230;  that&#8217;s a sad fact.  After 50 years of independence, Malaysians are not giving much damn about the welfare of other races.  The irony thing is&#8230; the arrest and roadblocks actually helped spreading Hindraf&#8217;s movement.</p>
<p><span id="more-143"></span>Hindraf is planning a gathering outside of British High Commission at Jalan Ampang on Sunday to submit a petition with 100,000 signatures to Queen Elizabeth II to appoint a Queen&#8217;s Counsel to represent the Indian community in a class action suit against the British government for bringing Indians as labourers to the then Malaya and thereafter exploiting them.</p>
<p>The suit, filed at the Royal Courts of Justice in London by Hindraf chief P. Wathyamoorthy in August, sought compensation of up to US$4 trillion (RM13.5 trillion), or US$1 million (RM3.4 million) for every Indian in Malaysia.</p>
<p>The petition and suit might sound ridiculous; people have been teasing the real motive behind the rally.  Regardless, I am not going to question the possible personal agenda in Hindraf organization&#8230;  I chose to believe that they want to seek international (and Malaysians&#8217;) attention on the problem the Indian society is facing in Malaysia, and that the suit is just a gimmick to get attention.</p>
<p>I am not a big fan of public rally or demonstration, but I am not going to deny the rights of others to voice their thoughts.  Besides, who would want to bath under the torching sun or soak in the rain (and possibly polices&#8217; tear gas and water cannon) to demonstrate if their voices are heard in a more comfortable way?  People go to the streets because they don&#8217;t have much choice, not for fun.</p>
<p>For whatever cause it is&#8230;  <strong>Don&#8217;t bring minors to a demonstration</strong>.  One thing that I absolute distaste during the BERSIH rally is seeing minors involved.</p>
<p>Street demo is always unpredictable; the crowd might go wild, or the police might become irrational in handling situations.  Violent confrontation might happen&#8230;  it&#8217;s not safe to bring your young children to a demo.  Forget about education from young age, that&#8217;s bull sh!t&#8230;  there are better ways teaching children about democracy, human rights or whatever.</p>

<p>Three police reports were lodged against blogger Jeff Ooi for allegedly defaming the country, government and police force.</p>
<p>The reports were lodged by the Malaysian Islamic Consumers Association, Malaysian Indian Muslim Congress and Pertubuhan Seni Silat Ikatan Kalam Malaysia against a statement issued by Ooi to an Al Jazeera reporter. The statement was allegedly broadcast on YouTube following an illegal gathering on Nov 10 organised by a coalition of opposition parties and non-governmental organisations calling itself Bersih.</p>
<p>The police reports were lodged at the Sentul police headquarters yesterday about 4.30pm.</p>
<p>The complainants want Ooi to be investigated, alleging that the interview given to Al Jazeera not only tarnished the image of the country but was also seditious and caused racial tension.</p>
<p>Ooi is also alleged to have given inaccurate information to Al Jazeera in stating that the police used unnecessary force in dispersing the demonstrators.</p>

<p>A businessman has lodged a police report against web portal Malaysia Today and its owner Raja Petra Kamaruddin for an article in the site which he alleged could cause disunity. </p>
<p>Noor Hisham Yusoh, 33, lodged the report at the Brickfields police station at about 7.30pm yesterday accompanied by seven other friends urging the authorities to carry out investigations into the article. </p>
<p>He said the article headlined “<a href="http://www.malaysia-today.net/nuc2006/index.php?itemid=326">What the eye does not see</a>” by Raja Petra had elements of instigation. </p>
<p>“As a Malaysian citizen, I think that his accusations are serious and can convince a lot of people in Malaysia that the country is not peaceful anymore,” he said, adding that the article could make the situation worse. </p>
<p>Noor Hisham from Bukit Subang said he decided to lodge the report after having a discussion with his friends who agreed that the article could cause disunity in the country. </p>
<p>“We are living in a very prosperous country and we do not want such an article to cause any problem,” he said.</p></blockquote>

<p>This is not the 1st time UPM is involved with similar confrontation; another student had his laptop confiscated in <a href="http://yeinjee.com/malaysia/2007/power-abuse-in-upm/">September</a> but his issue is settled sooner with the involvement of some opposition politicians.</p>
<p>I don&#8217;t like seeing lawyers and politicians involving in university affairs, but the lack of transparency from UPM in handling these disciplinary issues has left me no choice but to believe that the student is being victimized instead of some political agendas.</p>
<p>The disciplinary proceeding is a really bad joke as Lee&#8217;s lawyer mentioned.  Do UPM authorities really expect the students to just hand over their expensive belongings when told to do so without questions asked?  Besides, do they have enough reasons to do so?</p>

			<content:encoded><![CDATA[<p>I am not a supporter of the <a href="http://bersih.org/">BERSIH</a>&#8217;s yellow march yesterday (Nov 10) despite its great success (as claimed by the organisers).</p>
<p>I applaud the protesters&#8217; spirit to convey their thoughts;<br />
I condemn police&#8217;s action to use tear gas and water cannons on the protesters;<br />
I hope that the Election Commission (EC) could be more independent;<br />
I wish that the flaws in our electoral system could be minimized.</p>
<p>So why am I still not a supporter of the BERSIH rally?</p>
<p><span id="more-137"></span><strong>EC is not our main concern</strong></p>
<p>EC might be favouring our BN government in policies and having double standards when implementing certain things, but I still believe that we have a decent electoral system.</p>
<p>I doubt that there is any election in the world that is 100% clean, and I believe that our election is not that bad.</p>
<p>The main reason for BN&#8217;s dominance in the 2004 election is not the unfairness in election or the flaws in EC&#8230;  it&#8217;s because we don&#8217;t have a strong enough opposition party (or alliance).</p>
<p>The opposition parties need to buck up their reputation, attract more quality members, and think of a way to form a strong alliance against the current BN government.</p>
<p>One thing that the BN government managed to do well all these years is to keep their alliances intact&#8230;  it shows that Malaysians can work together regardless of occasional controversies.  That is something that the oppositions are far from emulating.</p>
<p>The BERSIH march is a good lead to show bonding among opposition parties&#8230;  work on it.</p>
<p><strong>The involvement of political parties</strong></p>
<p>It&#8217;s irony that both the success and failure of the rally are caused by the involvement of political parties.</p>
<p>Without them BERSIH would not have attracted such a large crowd; but their participation has made the rally a political driven protest instead of independent voices.</p>
<p>We may argue that BERSIH is formed by just 5 political parties and dozens of other NGOs&#8230;  but fact is the political parties&#8217; involvement will always grab the attention instead.</p>

<p>And here is an excerpt from AFP&#8230;</p>
<p>&#8220;Some 30,000 protesters eventually massed outside Malaysia&#8217;s royal palace, <strong>led by opposition leaders</strong> including dissident former deputy premier Anwar Ibrahim, as they faced off against hundreds of riot police.&#8221;</p></blockquote>
<p>We don&#8217;t need our biased local press to mislead the mass; even the independent news source would perceive that it&#8217;s an opposition rally&#8230; and I&#8217;m afraid that most bystanders would think of the same thing too.</p>
<p>It&#8217;s ok if the political parties take part in this kind of rally, but their leaders need to back off from taking the spotlight.  Let the NGOs handle the case instead, it shows more credibility ahead of political agenda.</p>
<p>Just a simple challenge to BERSIH supporters&#8230; name me 3 non political organizations that took part in the BERSIH rally.  I apologize in advance if you managed to name it straight away without references&#8230;  I doubt that I would need to apologize to most of the protesters though.</p>
<p><strong>Would BERSIH boycott the election?</strong></p>
<p>Would BERSIH move on to boycott the election if their demands are not granted?</p>
<p>If they chose not to boycott the coming election&#8230;  it shows that BERSIH still have faith with our electoral system ain&#8217;t so?  If that&#8217;s the case, why started the rally at the first place?</p>
